Living Trust Support Documents

  

A living trust package requires several core support documents to function properly. These include a Certification of Trust, a Pour-Over Will, Assignments of Property, Guardianship paperwork for Minor Children, a Durable Power of Attorney, and Advance Healthcare Directives. State rules, such as those governed by the California Courts, dictate proper signing and notarization. 


Core Supporting Documents


  • Certification of Trust: A short summary proving the trust exists without revealing private financial terms to banks.
  • Pour-Over Will: A safety net will that catches any stray assets left outside the trust and moves them in upon death.
  • Assignment of Assets: A formal document transferring general personal property and un-titled belongings into the trust.
  • Financial Power of Attorney: Names an agent to handle non-trust financial matters if you become unable to do so.
  • Healthcare Directive & HIPAA: Names a medical proxy and grants permission for doctors to share health data. 


Funding and Property Records


  • Deeds (Quitclaim or Grant Deeds): Used to legally transfer real estate titles into the name of the trust.
  • Financial Account Forms: New signature cards or beneficiary designations retitling bank, brokerage, and retirement accounts.
  • Asset Inventory / Schedule A: A master list of all property and account numbers assigned to the trust.
