A trustee has full discretion whether to distribute assets to the beneficiary, which means they can decide to distribute nothing at all. A creditor cannot force a distribution to satisfy a judgment and would not have any claim against the assets until they are distributed to the beneficiary.


  • Support trusts: A support trust is used to provide for a beneficiary’s education and living expenses. These types of trusts offer limited asset protection since a creditor would still be able to reach the assets if they can show they were not necessary for the beneficiary’s support.
